The issue is not looks, but rather:

the ITC found that Android's messaging app and browser infringed upon Apple patent #5,946,647, which covers automatically converting things like phone numbers and email addresses into actionable links that open a menu of options. The ban was delayed so HTC could engineer around Apple's patent claims, but it went into effect on April 19th — and although HTC claimed so-called "data tapping" was a "small UI experience" that would be completely removed from its US Android devices, Customs is now reviewing the One X and Evo 4G LTE.

Apple strikes again.

It seems like Apple believes it invented the majority of the features on the modern smartphone... I want to be able to click something in a text message... Apple patented the idea before it was integrated... so they should be paid every time a device is made that can click something in a text? Or are they even willing to take money in exchange for use of the patent? I understand some of their patent arguments, but many of the claims of infringement were virtually worthless when they filed the patent... I see the posts on engadget every few weeks about them patenting absent of ability. My favorite recollection is the "self cleaning touch screen".... They filed that and will now, under the current environment, want to sack anyone in the world who is able to accomplish it. It won't matter if they use a method different than apple describes, they'll still want to argue it. Apple is arguably stifling innovation by filing patents like this. Who is driving software innovation on smartphones right now? Not Apple.

Sometimes when I lay around the house and dream up crazy technology I hope to have in the future, I think about drawing pictures and filing patents on each and every idea.

That's such an obvious function. I mean, if I see an e-mail address on my computer, it's an actionable link that I can click on and do something with (like open my e-mail program and send a message). This is ridiculous.

This blows!!!!! Was looking forward to checking out the Evo 4g lte this weekend.

AT&T has a supply of the One X that was shipped prior to the April cutoff date. Apparently they can sell any they had on hand prior to that date until this gets settled.

In continuation of our earlier post – we can now (un)officially confirm that the FULL launch of the HTC EVO 4G LTE is now officially delayed. This is very preliminary, however, as of 11PM tonight, we can report:

• FULL Launch DELAY
  
• No pre-orders will be shipped
  
• No HTC EVO 4G LTE devices will be sold in stores on 5/18
  
• Internal conversations put the launch delay at least 10 days out, however that’s up to customs and a court right now
  

PLEASE NOTE: This can and likely will change over the next 12-24 hours, but as of right now, that is the status. We will know more after 10AM on Wednesday, and I’ll try to post an update as soon as I can after that.

It looks like the original June 10th release date is looking pretty good right now. Lets hope it doesn't take more than a week delay to resolve this stupid patent issue complained by crApple. Argh another reason to hate Apple.

Here's to hoping that the judge that will hear the case is one of many that pre-ordered his/her new Evo LTE.

Notice it says Full Launch.... There are phones that are already in the US and it has been reported that phones already in the US can be sold. I imagine those would be at least some of the preordered phones or third party POS inventory.

I just called the Best Buy I preordered from and they do have a limited stock in, but they won't be available until Friday and its limited to preorders first. They had not heard about the customs delay until it was mentioned, but check your 3rd party retailers as its likely they will have them.

I just called Best Buy and provided my order number. They said that while they are aware that there may be some delays, my phone is still on schedule to be delivered on 5/17. Hopefully this is is valid information.

Things would get ugly if a few B&M stores managed to fulfill their pre-orders and Sprint didn't.
